1. Acceptance of Terms

By accessing or using Clintix Pro ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Clintix Pro.

2. Service Description

Clintix Pro is an exam preparation platform designed for ACEM Primary and Fellowship candidates. The Service provides:

• AI-powered chat-based learning and exam preparation
• Curriculum-aligned practice questions and scenarios
• Document upload functionality for personalized study materials
• Progress tracking and learning insights

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Promptly update your account information if it changes
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use the Service.

4. Subscriptions and Billing

4.1 Subscription Plans

The Service offers various subscription plans with different features and usage limits. Plan details, pricing, and included credits are displayed on our pricing page at the time of purchase.

4.2 Credit System

The Service uses a credit-based system for usage tracking. Subscription plans include allocated credits that reset on your billing cycle. Additional credits may be purchased separately. Unused plan credits do not roll over to the next billing period.

4.3 Payment

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Prices are subject to change with reasonable notice.

4.4 Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation, you will retain access to the Service until the end of your current billing period. We generally do not provide refunds for partial subscription periods, except as required by law.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Share your account credentials with others or allow unauthorized access
• Use the Service during actual examinations or in ways that violate exam integrity policies
• Attempt to extract, scrape, or bulk download content from the Service
• Reverse engineer, decompile, or attempt to discover the source code
• Upload malicious content, viruses, or harmful materials
• Interfere with or disrupt the Service or its infrastructure
• Impersonate any person or entity
• Use the Service for any commercial purpose without authorization

6. Intellectual Property

6.1 Our Content

The Service, including its design, features, curriculum content, and all related intellectual property, is owned by Clintix Pro. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial educational purposes.

6.2 Your Content

You retain ownership of documents and materials you upload to the Service. By uploading content, you grant us a limited license to process, store, and use that content solely to provide the Service to you. You represent that you have the right to upload any content you submit.

6.3 AI-Generated Content

Responses generated by the AI are provided for educational purposes. While we strive for accuracy, AI-generated content may contain errors and should be verified against authoritative sources.

7. Disclaimers

7.1 No Medical Advice

The Service is an educational tool for exam preparation only. Content provided through the Service does not constitute medical advice, diagnosis, or treatment. Always consult qualified healthcare professionals for medical decisions.

7.2 No Guarantee of Results

We do not guarantee that using the Service will result in passing any examination. Success depends on many factors including your individual effort, study habits, and base knowledge.

7.3 Service Availability

The Service is provided "as is" and "as available." We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We may modify, suspend, or discontinue any aspect of the Service at any time.

8. Limitation of Liability

To the maximum extent permitted by law, Clintix Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of or inability to use the Service. Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Clintix Pro and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Extended period of inactivity
• Request by law enforcement or government agencies

Upon termination, your right to use the Service will immediately cease. You may request deletion of your account and personal data in accordance with our Privacy Policy.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

12. Governing Law
